Notary

Where a document is required for use overseas a solicitor is often not sufficient. Solicitors are generally licensed to practise in England and Wales and are not recognized in other jurisdictions.

In such instances, a Notary Public will be required who can witness and certify documents for use abroad. Often a document will also require an ‘apostille‘ which is a stamp applied by the Foreign Office confirming the Notary Public’s certification.

What is a Notary?

A Notary is an officially certified professional, usually a lawyer, with the power to administer oaths and statutory declarations, and to witness and authenticate documents.

A Notary deals with legal documents that will be used in another country. This might mean verifying translations to be used abroad, or verifying power of attorney on behalf of a client with property in a different country.

Foreign jurisdictions may require some documents to be legalised. Legalisation or, where necessary, an Apostille, is the process whereby a Notary's signature and seal is certified to be genuine. The methods of legalisation vary from one country to another and in the UK is obtained from the Foreign and Commonwealth Office. We are familiar with the procedures and are able to assist where these procedures are required.

What Documents Will I Need?

When visiting the Notary please ensure you have with you the following papers which are essential to establish your identity and your residential address.

  • Photo ID such as a passport
  • Proof of address no more than 3 months old, such as a utility bill
  • The document that needs to be authenticated.

All the above documents MUST be in their original.

 

Julian Kostick

Julian Kostick is our in-house Notary Public with years of experience in wide range of documents and in many jurisdictions. He regularly deals with adoption forms, property sales overseas, wills and trusts, powers of attorney and authenticating certificates. He can also arrange for an Apostille to be added to the document where required. Julian is also available for emergency out-of-hours or weekend appointment, if necessary.
